By using the pompom Service (“pompom,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms apply to all users and all features of the Service.

2. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you affirm you have the legal capacity to enter into these Terms.

3. Account Registration

You may create an account via email or supported third-party login. You are responsible for keeping your credentials secure and for all activity under your account. Notify us promptly if you suspect your account is compromised.

4. Service Overview

pompom provides AI-assisted marketing strategy generation and related content creation (“Content”). The outputs depend on your inputs and the credit usage system.

5. Credits & Payments

pompom uses a credit-based system to access certain features. Each AI generation consumes credits as defined in the app interface.

Credits are purchased via third-party payment processors and may expire according to the terms shown at purchase. Unless required by law, credits are non-refundable. We do not store full payment card details and are not responsible for third-party payment processor policies or errors.

6. AI Outputs & Ownership

You retain ownership of all outputs you generate through the Service. You may use these outputs for personal or business purposes.

We retain all rights to the underlying software, models, and infrastructure powering the Service. You may not reverse-engineer, copy, sell, redistribute, or republish the Service itself.

7. Acceptable Use

You agree not to use the Service to:

• Violate laws or intellectual property rights
• Generate harmful, fraudulent, illegal, or abusive content
• Interfere with the Service’s operation or security

8. No Business Advice Warranty

The Service is provided “as-is” and does not constitute business advice, consulting, or guaranteed strategy performance. AI outputs are suggestions based on your inputs and are not promises of results.

9. Disclaimer of Warranties

We make no warranties, express or implied, including accuracy, reliability, or fitness for a particular use.

10. Limitation of Liability

To the maximum extent permitted by law, pompom is not liable for any indirect, incidental, or consequential damages. Maximum liability for direct damages is limited to the amount you paid for credits in the three months prior to a claim.

11. Termination

We may suspend or terminate your access for violations of these Terms or at our discretion. You may request deletion of your account and data by contacting us; data will be deleted or anonymized except where retention is required by law.

12. Governing Law

These Terms are governed by the laws of the place where you reside or where the operator is located, as applicable.
